Digital Gift Card and Prize Drawing Terms and Conditions - User Survey

Terms and Conditions of Netskope Customer Survey for a Digital Gift Card and Entry for Prize Drawing (the “Promotion”) by Netskope, Inc. of 2445 Augustine Drive, Suite 301, Santa Clara, CA 95054 (“Netskope”). By participating in the Promotion, each participant agrees to these Terms and Conditions.

Participation: Participants who complete and submit a complete survey response to the Promotion before October 31st, 2023 (“Participation Deadline”) will receive a digital gift card valued at $25 and a single entry for a prize drawing, where the prize is valued for up to $249.

The Gift Card: Netskope will provide the gift card digitally within 60 days of the Participation Deadline to the email address provided by the participant. The gift card cannot be redeemed for cash or substituted. Netskope reserves the right to substitute the digital gift card with another gift card of equal or greater value.

The Prize: Netskope has selected a prize for the drawing, valued at $249. There is only one prize available for the drawing within the Promotion, which will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize drawing winners are unable to transfer or assign the prize to another or redeem the prize for cash. Netskope may substitute the prize of the drawing with a prize of equal or greater value at Netskope’s sole discretion.

Prize Drawing Selection Process: Upon completing a survey response to the Promotion by the Participation Deadline, Netskope will create a single entry for that participant. The entry will be for a prize drawing. After the Participation Deadline, Netskope will choose a participant entry at random to be selected as a winner from all of the eligible participant entries. The winner will be notified by Netskope within two business days after being selected as the winner. The winner will have up to two business days to accept the prize in writing by responding to the email notifying them of their win. Should the winner (a) fail to accept the prize in writing within two business days of being notified of their winning selection, or (b) choose to reject the prize, Netskope will choose a different participant at random. The drawing to select an alternative winner shall be from all the remaining eligible participant entries. Should the alternative winner also fail to accept or reject the prize, Netskope shall continue random selection in the remaining eligible participant entries, until the prize has been accepted by an alternative winner.

The winning participant will need to provide and confirm an address for Netskope to mail the prize to the winner. Netskope will mail the prize to the winning participant within 60 days of receiving both (a) the winner’s written acceptance of the prize, and (b) the winner’s mailing address.

Eligibility: Participants must be at least 18 years of age and may only submit one response to the survey. Participants must have received an email from Netskope inviting them to participate in the Promotion. The Promotion is void in jurisdictions where prohibited or restricted by law. Employees and contractors of Netskope and their immediate families and those living in their households are not eligible. The Promotion is governed under U.S. law and values are determined in U.S. dollars. All applicable federal, state and local laws apply. If a participant is unable to accept the drawing prize, for any reason, to include employment or regulatory reasons, the participant is responsible for either rejecting their entry into the drawing, or rejecting the prize if the participant is selected as the winner.

Privacy: All personal information provided to Netskope in connection with the Promotion by participants will be treated in accordance with Netskope’s privacy policy available at: https://www.netskope.com/privacy-policy. Any personal information shared with a third-party is subject to the third-party’s privacy policy.

General Conditions: Netskope reserves the right to cancel or modify the Promotion if fraud, technical failures or any other factor beyond Netskope’s reasonable control impairs the integrity of the Promotion or delivery of a prize, as determined by Netskope in its sole discretion. Netskope is not responsible for technical failures of any kind, including the unavailability or inaccessibility of any transmissions or telephone or internet service. Each participant is solely responsible for all income and other taxes and other fees.

Disputes: Any and all disputes, claims and causes of action arising out of this Netskope Promotion shall be resolved exclusively by the United States District Court or appropriate state court located in the Northern District of California. These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules.
